he\u00a0Criminal Code<\/b>[1]<\/a><\/sup>\u00a0or\u00a0Code criminel<\/b>[2]<\/a><\/sup>\u00a0is a law that\u00a0codifies<\/a>\u00a0most\u00a0criminal<\/a>\u00a0offences and procedures in\u00a0Canada<\/a>. Its official long title is “An Act respecting the criminal law<\/b>” (R.S.C. 1985, c. C-46, as amended). Section 91(27) of the\u00a0Constitution Act, 1867<\/a>\u00a0establishes the sole jurisdiction of\u00a0Parliament<\/a>\u00a0over criminal law in Canada.<\/p>\n

The Criminal Code contains some defences, but most are part of the\u00a0common law<\/a>\u00a0rather than\u00a0statute<\/a>. Important Canadian criminal laws not forming part of the code include the\u00a0Firearms Act<\/a>, theControlled Drugs and Substances Act<\/a>, the\u00a0Canada Evidence Act<\/a>, the\u00a0Food and Drugs Act<\/a>, the\u00a0Youth Criminal Justice Act<\/a>\u00a0and the Contraventions Act.<\/p>\n
